Despite the PMLA’s stringent rules, sick and infirm people may be released on bail: The Supreme Court

On Monday, the Supreme Court emphasised the importance of granting bail under the Prevention of Money Laundering Act (PMLA) to those who are ill or infirm.

Justices JB Pardiwala and Manoj Misra, together with Chief Justice of India (CJI) DY Chandrachud, emphasised that although the PMLA and other statutes are strict when it comes to granting bail, the Court must nevertheless operate within the confines of the law.

“However stringent PMLA is, we have to act by law. If someone is sick or infirm they can be granted bail. See the medical board report,” the Court said.

Consequently, the Court has granted interim bail to Amar Sadhuram Mulchandani, the former Chairman of Seva Vikas Co-operative Bank, who was apprehended by the Enforcement Directorate (ED) on charges of money laundering.
