Mumbai: Order To Refund Rs 11.6 Crore To Buyer Misled By ‘Tallest Building Ever’ Claim

The Mumbai Consumer Court recently granted a return of Rs. 11.65 crore to a flat purchaser who reserved a unit in “World One” after it ceased to be the world’s tallest building.

A report claims that the buyer said the house’s height was the sole factor in his decision to purchase it, which is no longer the case.

When it became clear that the apartment would not be the tallest, the buyer stopped making further payments for the 38th-floor apartment he had reserved.

In response to complaints, the purchaser proceeded to consumer court and asked for possession of his apartment in “World One,” which had all 117 storeys built with all necessary permits from the authorities, as well as any delayed reimbursement or refund with 18% interest.

MUMBAI CONSUMER COURT’S VERDICT

The Commission noted that the buyer’s goal was to own a home in the highest building in the world, and that this was also implied by the representations made to him.

He had been promised a unit in the 117-story skyscraper, as the brochures had made quite apparent.

The customer was allegedly presented with a profitable color brochure and their representative persuaded them that Mumbai’s “World One” would be the highest residential structure in the world, with 117 higher storeys and many parking levels.

It also pointed out that the building’s height had been misrepresented, and that the opposing party had not provided any proof that the 2013 Airport Authority of India order authorizing construction up to a height of 284.29 meters had at that point gained widespread attention.
