SC Declines To Have A Quick Hearing On Uddhav Thackeray’s Request For Recognition Of The “real” Shiv Sena

On Tuesday, the Supreme Court declined to hold an urgent hearing on a petition from the Uddhav Thackeray group challenging the Election Commission’s recognition of the genuine Shiv Sena.

The Thackeray faction has argued before the Supreme Court in opposition to the EC’s decision to recognize the Shinde group as the legitimate Shiv Sena.

According to PTI, attorney Amit Anand Tiwari requested an urgent hearing before a bench presided over by Chief Justice DY Chandrachud.

“Wait for the Constitution bench on Jammu and Kashmir to get over, and we will give a date,” the bench, which also included Justices JB Pardiwala and Manoj Misra, stated.

According to the petition, the election panel erred in ruling that MLA disqualification is not predicated on ceasing to be a member of a political party and that disqualification under the Tenth Schedule and procedures under the Symbols Order function in separate worlds.

Additionally, it claimed that the polling organization erred in concluding that the Shiv Sena had divided.

The electoral commission assigned the “bow and arrow” election emblem of the unified party created by the late Balasaheb Thackeray after recognizing the Eknath Shinde-faction as the true Shiv Sena.
