The Speaker Must Determine As Soon As Possible Whether To Disqualify 16 MLAs: Uddhav

Uddhav Thackeray, the leader of the Shiv Sena (UBT), called on Maharashtra’s Assembly Speaker Rahul Narwekar to decide as soon as possible whether to disqualify 16 MLAs.

He made the claim the day after the Supreme Court issued its ruling on the political crisis of the previous year, which led to the fall of the three-party Maha Vikas Aghadi (MVA) administration he headed as a consequence of Eknath Shinde’s uprising and subsequent alliance with the BJP to become the chief minister. Anil Parab, a member of Thackeray’s party, said that they will write to Speaker Nawerkar to urge him to make a decision as soon as possible.

Because the Supreme Court set a fair time frame with restrictions, the 16 MLAs’ gift of life is only transitory. The Speaker has to make a decision as soon as possible, Thackeray added.

Thackeray cited the Supreme Court’s ruling that he might have retained his position as chief minister had he not resigned, claiming that this means that the governor’s actions, such as asking him to take a floor test, were unlawful.

Therefore, the current administration is unconstitutional. I quit because of moral obligation, therefore I’m happy with my choice, Thackeray remarked.

Additionally, he challenged the Shiv Sena-Bharatiya Janta Party to run for office in the “final court,” which he said was made up of the state’s citizens.

We have been arguing that this regime is unconstitutional, Parab remarked. The whip plays a crucial function. The whip at the time belonged to Sunil Prabhu, a lawmaker from the Thackeray group, and it was broken, as has long been documented. It shouldn’t take the Speaker very long to make a decision.

The dissident MLAs have little time remaining and no means of escape, said Parab. The Supreme Court ruled on Thursday that Thackeray’s MVA government could not be reinstated since he resigned in June of last year without taking a floor test. It has requested that the Speaker determine within a “reasonable period” whether to disqualify 16 MLAs.

The court also ruled that it was unlawful for the Speaker to designate Bharat Gogawale of the Shinde faction as the Shiv Sena’s whip in the Assembly.

According to the top court, regarding the actions of the then-Gov. Bhagat Singh Koshyari, “The governor was not justified in calling upon Mr. Thackeray to prove his majority on the floor of the House because he did not have reasons based on objective material to reach the conclusion that Mr. Thackeray had lost the confidence of the House.”
