In response to a petition noting the absence of a burial area in the city’s eastern suburbs, the Bombay High Court said on Tuesday that deceased people had a basic right under the Constitution to be buried with dignity.
The Maharashtra government and the Brihanmumbai Municipal Corporation (BMC) were criticized for their lax response to the situation by a bench comprising Chief Justice D K Upadhyaya and Justice Arif Doctor.
In order to find more burial places in the eastern suburbs, Govandi residents Shamsher Ahmed, Abrar Chaudhari, and Abdul Rehman Shah filed a petition with the bench.
According to the legislation, the municipal commissioner is obligated to provide a suitable location for the deceased to be disposed of. The commissioner must immediately locate another location, the panel ruled.
You must care for the deceased as much as the living, the court said.
According to Article 21 of the Constitution, they are entitled to a dignified funeral. Can you interpret the meaning if dead corpses start to appear? Do you need court orders in these circumstances? The court ruled that such a careless approach in this situation, shown by both the BMC and the state government, cannot be excused.
