The Election Commission of India put a stop to the intra-party conflict inside the Nationalist Congress Party on Tuesday, February 6. The Ajit Pawar-led group won the ruling by the EC. He can now use the party emblem “clock” and identify his faction as the original or real NCP. The ruling follows more than ten hearings conducted over the course of more than six months by eminent legal teams.
The ruling is consistent with the established criteria for whether a petition of this kind can be maintained. This comprises majority tests for both organisational and legislative purposes, as well as tests of the party’s goals and objectives as stated in the constitution. Given that both parties are operating outside of the party constitution and organisational elections, the legislative wing’s test of majority was deemed appropriate in this particular situation. As a result, according to news agency ANI, the incumbents of the position were mostly seen to have been chosen by electoral college members who had nominated themselves, which went against party democracy.
According to reports, the Sharad Pawar group’s claim of having the backing of the organisational majority and its timeliness were seriously inconsistent. Their assertion became untrustworthy as a result.
In the meantime, the Sharad Pawar faction has been granted a special concession to comply with Rule 39AA of the Conduct of Elections Rules 1961, which permits the authorised agents of political parties to verify as to whom an elector, who is a member of a political party, has cast his vote. This is due to the significant timeline of the elections for the six Rajya Sabha seats in Maharashtra.
The Sharad Pawar faction now has a one-time opportunity to claim a name for their new political organisation and furnish the Election Commission with three preferences, thanks to the Election Commission’s use of its powers. By February 7, 2024, at 3 p.m., the concession must be in use.
