The Delhi High Court on Friday permitted a teenage Nepalese gangrape victim to have her 27-week pregnancy medically terminated.
The medical board is of the opinion that a medical abortion could be performed, but the court issued the order after hearing from two doctors from Lok Nayak Jai Prakash (LNJP) Hospital that there is a risk to the minor due to her low haemoglobin level and the pregnancy’s 27-week gestational period.
The victim’s mother requested the termination of the girl’s pregnancy after claiming that her daughter had been viciously gang-raped in Nepal in October 2022 when she and her husband were working in Delhi.
As a result, Justice Prathiba M. Singh ordered that the pregnancy be terminated as soon as possible by the medical staff at LNJP Hospital, notwithstanding the fact that the kid and family were born in Nepal.
The girl discovered she was pregnant after relocating to India with her parents in March, but the gestation period had already reached 25 weeks by the time she sought help from the appropriate authorities.
The maximum gestational time at which a pregnancy may be terminated is 24 weeks.
The child should get the greatest post-operative care possible, the court further ordered the physicians, so that she may only be released after she has recovered.
It was said that the family had promised to provide the child proper care if it were to be born alive.
