Jailed gangster Rajendra Nikalje alias Chhota Rajan has filed a petition in the Bombay High Court on Thursday against the web series “Scoop”. This series is going to be released on 2 June on the OTT platform ‘Netflix’. Chhota Rajan has said that “his image is being misused without his prior consent” which amounts to defamation as well as infringement of his “personal rights”. Chhota Rajan is currently lodged in Tihar Jail.
The gangster has requested a court order to stay the release of the series and remove its trailer. He also sought an injunction restraining the makers of the series, including Hansal Mehta and Netflix Entertainment Services India, from infringing on his personal rights. Rajan also sought a compensation of Rs 1 to be paid to him or the money earned by the producers through the telecast of the series’ trailer to be deposited for “public good or upliftment of society”.
What did Chhota Rajan say in the petition
Rajan said in his petition that in May 2023 he was told about the trailer of the series by his wife. The petition states that the makers of the series never had prior permission to use/misuse Rajan’s name and image, associate him with any voice and/or any programme. “Therefore, the use or misuse of the personality characteristics of the Plaintiff (Rajan), including his name, caricature, image, and/or any other direct/indirect reference, without obtaining the prior consent of the Plaintiff,” the petition states. There is a violation of the right to personality of the plaintiff and it is worth defamation. ”It is being told that now a vacation bench of the High Court can hear the petition on Friday.
