In order to get a police case against India cricketer Prithvi Shaw for allegedly assaulting and upsetting her modesty at a club in the district of Andheri two months ago, social media personality Sapna Gill filed a criminal complaint in a Mumbai court. In order to register a FIR under IPC sections 354 (assault of criminal force to a woman with the intent to outrage her modesty), 509 (word/gesture/act intended to insult the modesty of a woman), and 324 (voluntarily causing hurt by dangerous weapons or means), a complaint was filed against Shaw and his friend Ashish Yadav before the Andheri magistrate’s court, according to Gill’s attorney Ali Kaashif Khan.
The 23-year-old cricketer is accused by the complaint of hitting her with a bat in February. To bolster the allegations against the accused, a medical certificate from a government hospital has been added to the lawsuit, according to Khan.
According to the attorney, a second complaint was made against the employees of the Airport police station for failing to do their duty and submitting a FIR (first information report) under IPC section 354 against Shaw and others in response to an earlier Gill complaint.
On April 17, the court is anticipated to hear both cases. After a disagreement about taking pictures at a hotel in a nearby area, Gill and a few other people were detained in February in connection with an alleged assault on Shaw. For now, she is free on bail.
Gill went to the Airport police station in Andheri with a complaint against Shaw, his buddy Ashish Yadav, and others after being given bail in the assault case for allegedly insulting her modesty. Police have not yet filed a FIR against the Mumbai batsman, however. According to the lawsuit Gilll filed with the court, she and her friend Shobhit Thakur frequent the exclusive club, when the latter saw Shaw who was apparently intoxicated and partying with his buddies.
The application said that Thakur, a cricket lover, tried to take a photo with Shaw but was greeted with “hostility.” Thakur, a young adolescent, was not aware of the viciousness of the inebriated crowd. Thakur was unable to protect himself and was powerless. In order to prevent Shaw and others from hurting and wounding Thakur further, she (Gill) joined the struggle and interfered, according to the lawsuit.
Shaw allegedly grabbed Gill improperly and pulled her away as Gill tried to protect Thakur from the attack. The complaint claimed that as a result, the accused had committed the unlawful and grave offence of upsetting the victim’s modesty.
