The Bombay High Court has made it clear that the father will be freed from the responsibility of maintaining the daughter only after her marriage, otherwise in the absence of proof of earning of the adult daughter, it is the duty of the father to take care and maintain her. The High Court said this while rejecting the husband’s petition against increasing the amount of maintenance of his wife and daughter. In the petition, the husband had claimed that his wife and daughter get Rs 250 and Rs 200 per day respectively from the agriculture business. In the year 2021, the adult daughter got married, while the wife left his side. Therefore mother and daughter are not entitled to maintenance. In 2015, the Family Court had directed to pay Rs 8,000 to the wife and Rs 7,000 to the daughter as maintenance considering the husband’s salary was more than Rs 46,000.
Earlier in 2006, the court had directed the husband to give Rs 1,200 to the wife and Rs 1,000 to the daughter. According to the husband’s petition, the family court has not considered his financial condition while fixing the maintenance. 27 thousand rupees are deducted from his salary. Out of this, Rs 15,000 goes towards repaying the loan installment taken from the staff society. In this regard, the maintenance amount is quite high.
Justice Bharti Dagre said after the hearing that the amount of maintenance has been increased at intervals of several years. This amount has been increased after considering the husband’s salary. Therefore, there is no flaw in the decision to increase the amount of maintenance. The petitioner will be free from the responsibility of maintenance of the adult daughter only after her marriage.
