Mumbai: A Mumbai court recently granted temporary bail to a 62-year-old man arrested in a cheating case on “medical and humanitarian grounds”, two days after his death. Suresh Pawar died hours after the hearing on his bail application was over on May 9, while Additional Sessions Judge Vishal S Gaike granted him temporary bail two days later. Pawar was arrested for allegedly selling a property to a real estate agent on the basis of forged documents.
Pawar was in jail since 31 December 2021 and had sought temporary bail for six months on medical grounds. Pawar had said in his application that he is severely diabetic and is also suffering from several age-related ailments.
In February, he injured his toe and was admitted to the government-run JJ Hospital, from where he was later discharged. It was said in the petition that his toe developed gangrene and had to be amputated.
According to the petition, the High Court had in March directed the jail authorities to provide proper medical treatment to Pawar and on April 19, he had withdrawn his bail application from the High Court.
The petition said that on the same day, Pawar’s health deteriorated and he had to be admitted to JJ Hospital again. However, due to lack of proper medical treatment, his wound became septic and his leg had to be amputated below the knee.
According to the petition, the accused developed a lung infection and sought temporary bail for six months for medical benefits.
In its order, the court said that keeping in view Pawar’s age, serious medical complications and further need for medical care, his prayer for provisional bail may be considered purely on humanitarian grounds.
