The special court Mumbai has allowed the transfer of Kapil Wadhawan, accused in a case related to the alleged scam in Yes Bank, to Nashik district jail. The permission has been granted after some media reports mentioned ‘malpractice’ during Wadhawan’s hospital treatment. The Wadhawans, one of the promoters of Dewan Housing Finance Limited (DHFL), are accused in several fraud cases being probed by the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI). He was lodged in Taloja jail of Navi Mumbai. He was repeatedly taken to the hospital in the name of treatment. It is alleged that during this time the Wadhawan brothers used to eat home food by parking the vehicle. Used to spend time with family. He used to hold office meetings and after being out for the whole day, was brought back late in the evening.
Special Judge for Prevention of Money Laundering Act and CBI cases MG Deshpande passed the order allowing the authorities to transfer the Wadhawans. He was immediately shifted to Nashik. Recently it came to light that whenever the Wadhawan brothers (Kapil and co-accused Dheeraj) were admitted to government hospitals, they met their relatives and used mobile phones and laptops. Thereafter, the jail authorities filed an application before the special court seeking transfer of Kapil Wadhawan to another jail. The application states that Kapil Wadhawan was admitted to government hospitals for various medical problems, but he did not actually get treated or even examined there.
The judge said, “It is an established norm that a court should not be influenced by media reports and media trial, but if some real picture with respect to the conduct of the accused involved in serious offenses is reported by the higher authorities of the jail. And if on inquiry the report is found to be correct then certainly the court cannot ignore it.” The Wadhawans did not report any serious illness in their applications to the court, but the jail superintendent (Taloja Jail) sent them to hospitals 15 times between June and August 2023. The order states that permission has been given to shift them to Nashik Road Jail.
