Shiv Sena UBT advocate Dharam Mishra ahead of the ruling on the disqualification petitions of the MLAs on Wednesday. Mishra stated that the party is anticipating a favorable ruling because, over the course of the last two years, the case has successfully navigated all legal obstacles, including the Bombay High Court, the Election Commission, the Supreme Court, and the tribunal.
He claims that if the Shiv Sena UBT loses the lawsuit, the group would approach the Supreme Court.
“In the Supreme Court’s most recent ruling, it acknowledged Sunil Prabhu’s whip and rejected their assertion that Bharat Gogawale was the Shiv Sena’s whip.We brought up the topic of time consumption in this particular example because, should the Lok Sabha elections take place in April, we won’t have much time to prepare. If the order is in our favor, we will get right to work on the party’s agenda and begin preparing for the polls. If not, however, we will not waste time in approaching the Supreme Court, which has already directed the Speaker to deliver the decision, Mishra told News18.
“Judicial review is still an option, but it will take time,” he said. Since the Supreme Court has issued the final ruling in this matter, I don’t think the tribunal will reject our requests.
After 4 PM today, Maharashtra Assembly Speaker Rahul Narwekar is anticipated to declare the judgment.
Sena Shiv On January 9, UBT leader Uddhav Thackeray noted that his party had objected to the recent visit by Narwekar to Chief Minister Eknath Shinde in a document submitted with the Supreme Court, prior to the ruling. He accused Narwekar of “delaying tactics” and informed the media that he was delaying the ruling.
The Maha Vikas Aghadi (MVA) coalition administration led by Thackeray was forced to quit without a floor test, and the Supreme Court had decided in May of last year that Shinde would remain as the Chief Minister of Maharashtra. However, the then-Governor BS Koshyari’s decision to request a floor test to settle an intra-party disagreement was questioned by the highest court.
